No Surprises Act & Good Faith Estimate
Under the law, the No Surprises Act of the 2021 Consolidated Appropriations Act that went into effect January 1, 2022, healthcare providers need to give patients who don’t have insurance or who are not using insurance an estimate of the bill for medical items and services.
Your Rights Under the No Surprises Act
You have the right to receive a Good Faith Estimate (GFE) if you are paying out-of-pocket or not using insurance. The GFE provides an estimate of the expected cost of therapy and related services before your first appointment.
Key Information:
- GFEs include typical therapy session costs, but do not include:
- Missed or late appointments
- Subpoena responses, court appearances, or documentation requests
- Additional phone or email consultations outside of scheduled sessions
- The GFE is an estimate only and is not a contract; session frequency, length, and costs may change based on your clinical needs.
- GFEs are reassessed at least once per year, and you will receive notice of any changes prior to services.
- If you are billed $400 or more above the GFE, you have the right to dispute the charge through the HHS dispute resolution process. Instructions and forms are available at CMS No Surprises Act or call 1-800-985-3059.
